Terms of service

Article 1 (Purpose)

The purpose of these Terms and Conditions (“Terms”) is to define the rights, obligations, and responsibilities between THE CHEONG AN BIO (“Company”) and the users (“Users”) regarding the use of the internet-based services (“Services”) operated by THE CHEONG AN (“Mall”).


Article 2 (Definitions)

  1. “Mall” refers to the virtual business platform established by the Company for Users to purchase goods and services.

  2. “Users” refer to both registered members and non-members who access the Mall and use the Services.

  3. “Members” refer to Users who provide personal information, register an account, and continuously receive the Services.

  4. “Products” refer to handmade soaps and related goods provided by the Company.


Article 3 (Posting and Modification of Terms)

  1. These Terms, along with business information, shall be posted on the Mall for easy access.

  2. The Company may amend these Terms to comply with applicable laws, including U.S. Federal Trade Commission (FTC) regulations, the Uniform Commercial Code (UCC), state e-commerce regulations, and consumer protection laws.

  3. Significant amendments unfavorable to Users shall be announced at least 30 days prior to enforcement.

  4. Continued use of Services constitutes acceptance of the amended Terms.


Article 4 (Applicable Laws)

Any matters not specified herein shall follow applicable U.S. federal law, California state law, and relevant consumer protection statutes.


Article 5 (Services Provided)

The Company provides the following Services:

  1. Display of product and service information

  2. Order placement and confirmation

  3. Shipping and delivery of purchased goods

  4. Customer support and other services deemed necessary by the Company


Article 6 (Suspension of Services)

  1. Services may be temporarily suspended due to system maintenance, repairs, or unavoidable causes.

  2. The Company is not liable for damages caused by suspension unless proven negligent.

  3. If business is terminated or merged, the Company shall notify Users in advance and provide compensation where applicable.


Article 7 (Membership)

  1. Users may register for membership by completing the Company’s prescribed form and consenting to these Terms.

  2. Membership may be denied if:

    • False or fraudulent information is provided

    • The User previously lost membership rights and has not been reinstated

    • The registration is deemed technically disruptive

  3. Members must notify the Company of changes to personal information without delay.


Article 8 (Withdrawal and Disqualification)

  1. Members may withdraw from membership at any time.

  2. The Company may suspend or terminate membership if:

    • False information was registered

    • Payment obligations were not fulfilled

    • Services were misused to harm others or disrupt operations

    • Illegal or unethical activities were conducted

  3. Repeated or unrectified violations may result in permanent disqualification.


Article 9 (Notices)

  1. Notices to Members shall be delivered to their registered email address.

  2. Notices to unspecified Users may be posted publicly on the Mall.


Article 10 (Purchase Application)

Users may apply for purchases by following the on-site process:

  1. Select products

  2. Enter personal and shipping details

  3. Confirm order and policies

  4. Select payment method


Article 11 (Formation of Agreement)

  1. An order is considered accepted when the Company issues an order confirmation email.

  2. The Company may decline orders if:

    • The order contains false or fraudulent information

    • Products are restricted by law (e.g., minors purchasing prohibited goods)

    • The order cannot be fulfilled due to stock or technical limitations


Article 12 (Payment Methods)

  1. Accepted payment methods include:

    • Credit/debit cards

    • Electronic payments (PayPal, Shopify Payments, etc.)

    • Other methods provided at checkout

  2. Additional fees (shipping, taxes, duties) are borne by the User.


Article 13 (Order Confirmation and Cancellation)

  1. Users will receive an order confirmation email.

  2. Orders may be canceled before shipment. After shipment, the Return & Refund Policy applies.


Article 14 (Shipping and Delivery)

  1. Products shall be shipped within 7 business days, unless otherwise specified.

  2. Once products are handed to the carrier, risk of loss transfers to the User.

  3. Customs duties, taxes, or delays caused by customs clearance are the User’s responsibility.


Article 15 (Refunds for Unavailable Products)

If the Company cannot supply an ordered product due to being out of stock, the User will be notified and refunded within 3 business days.


Article 16 (Returns and Refunds)

  1. Returns and refunds are governed by the Return & Refund Policy.

  2. Handmade Disclaimer: Variations in shape, weight, color, or scent of handmade soaps are normal and not considered defects.

  3. Eligible Returns:

    • Defective, damaged, or incorrectly delivered items → Company bears return shipping costs.

    • Change of mind → Customer bears return shipping costs.

  4. For hygiene reasons, opened/used soaps cannot be returned unless defective.

  5. Amazon FBA Orders: Returns and refunds follow Amazon’s FBA return process.


Article 17 (Refund Process)

  1. Refunds will be processed within 10 business days of product return confirmation.

  2. Refunds will be issued to the original payment method.

  3. Initial shipping costs, duties, and taxes are non-refundable unless legally required.


Article 18 (Privacy Protection)

  1. The Company collects minimal personal information necessary for order processing.

  2. Personal data is processed per the Company’s Privacy Policy and, where applicable, GDPR/CCPA regulations.

  3. Users may request access, correction, or deletion of their personal data.


Article 19 (Duties of the Company)

The Company shall:

  • Operate lawfully and in good faith

  • Protect personal information with security measures

  • Avoid false/misleading advertising


Article 20 (Duties of Users)

Users shall not:

  • Provide false or fraudulent information

  • Infringe intellectual property rights

  • Disrupt business operations or commit unlawful activities


Article 21 (Relationship with Shopify)

The Mall is powered by Shopify. However, all transactions are solely between Users and THE CHEONG AN.


Article 22 (Intellectual Property)

All trademarks, content, and images belong to the Company or its licensors.


Article 23 (Feedback)

By submitting feedback, Users grant the Company a license to use feedback for service improvement.


Article 24 (Dispute Resolution and Governing Law)

  1. These Terms are governed by U.S. federal law and California state law.

  2. Disputes shall fall under the exclusive jurisdiction of the Los Angeles County courts, California.
